The terms that apply when you use alloutfishing.com.au or buy from us. By using the site or placing an order you accept these terms.

1. Who we are
These terms are between you and All Out Fishing & Tackle (ABN 74 686 262 975), of 105 Shannon Ave, Manifold Heights VIC 3218 ("we", "us", "our").
2. The site
We do our best to keep alloutfishing.com.au accurate, available and secure. We don't guarantee uninterrupted access or that the site will be free of errors. We may update, suspend or withdraw any part of the site without notice.
3. Your account
You don't need an account to buy from us, but if you create one you're responsible for keeping your login details safe and for anything done under your account. Tell us straight away if you think someone else has accessed it.
4. Pricing and product information
Prices are in Australian dollars and include GST. We try to keep product descriptions, images and pricing accurate but mistakes happen. If we discover a clear pricing or description error afteryou've placed an order, we'll contact you to either honour the corrected detail (with your approval) or cancel and refund the order in full.
Stock shown on the site is live but reflects the position at the time the page was loaded. Where the same item is sold both online and in-store, very rare double-bookings can occur — see the Click & Collect FAQ for what happens then.
5. Orders and payment
Submitting an order is an offer to buy at the displayed price. The order is accepted when we send the order confirmation email. We may decline orders for any reason, including suspected fraud, stock availability, or shipping restrictions on hazardous goods.
Payment is handled by Stripe. We don't see or store your full card number — Stripe does that on our behalf. By placing an order you authorise us (via Stripe) to charge the card you nominate for the full order total.
6. Shipping, Click & Collect and risk
See the Shipping & Returns page for the operational detail. Risk in goods passes to you when the carrier scans the parcel as delivered, or — for Click & Collect — when you collect it from the store.
7. Returns and consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You're also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our standard 30-day change-of-mind policy applies on top of those consumer guarantees and is set out in full on the Shipping & Returns page.
8. Acceptable use
Use the site lawfully and respectfully. Don't scrape it, attempt to interfere with its operation, attempt to access systems you're not authorised to access, or post abusive, defamatory or unlawful content (e.g. in product reviews or community posts). We reserve the right to remove content and restrict access where we consider it warranted.
9. User-generated content
If you submit reviews, fishing reports, photos or other material to us, you grant us a non-exclusive, royalty-free, worldwide licence to host, display, edit and reproduce that material on the site and our marketing channels. You confirm you have the right to grant that licence and that the material doesn't infringe anyone else's rights or violate any law.
10. Intellectual property
The site, its design, the All Out Fishing brand, the logo, our photography and our copy are owned by us or licensed to us. Brand names and product images of third-party manufacturers are the property of their respective owners.
11. Limitation of liability
Nothing in these terms limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent the law allows, our total liability for any loss arising from your use of the site or a purchase is limited, at our option, to replacing the goods, repairing them, or refunding the price you paid for them.
We're not liable for indirect or consequential losses (such as lost fishing time, lost catch, or trip costs) except where the law requires otherwise.
12. Privacy
Personal information collected through the site is handled in accordance with our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the version published when you placed the order. We'll show the "Last updated" date at the top whenever we change anything material.
14. Governing law
These terms are governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction over any dispute arising under them.
